In 1994, plaintiff Excelcon Construction Corporation and defendant Ambal Enterprises, Inc. entered into a construction contract for rehabilitation and remodeling of commercial property. The plaintiff sued to collect $31,850 for change orders not executed by the defendant. The plaintiff admitted responsibility for the roof leaks and acknowledge that a cost of repair of $3,512 was owed to the defendant as an offset against the $31,810 in unpaid change orders. The plaintiff brought this action against the defendant based on breach of contract and mechanic's lien foreclosure.
