On Oct. 14, 1993, the plaintiff, a 48-year-old accounting clerk, slipped and fell on a wet floor in the defendant's building. A flood occurred from the toilet in the men's restroom which had overflowed and migrated to the exterior of the women's restroom. The defendant employer noticed the flood and allegedly contacted the defendant security and maintenance companies. The plaintiff brought this action against the employer, the maintenance company, the security company and the owner of the building based on premises liablity and negligence theories of recovery.

The settlement was reached approximately one year and eight months after the case was filed. ARBITRATION: An arbitration was held in October 1996 before Sal Grayson resulting in an award of $450,000. The defendants requested a trial de novo. $150,000 was paid by workers' compensation.
