Facts

On April 13, 1995, plaintiff Mehdi Sarraf, a wholesale fabric salesman, went to defendant Authentic Fitness' warehouse to view excess fabrics for sale. The plaintiff used a ladder to obtain samples of the fabrics available. After going up and down the ladder 20 to 30 times, the plaintiff, on the last descent, missed a step and fell. The plaintiff brought this action against the defendant based on premises liability and negligence theories of recovery.

Settlement Discussions

The plaintiff made a C.C.P. º998 settlement demand for $30,999. Before the trial, the defendant offered to waive cost in exchange for a voluntary dismissal.

Injuries

The plaintiff alleged that he suffered a torn meniscus.

Other Information

The decision was rendered approximately one year after the case was filed.
