On Aug. 19, 1993, plaintiff Bebek, a 70-year-old woman, was shopping in a defendant K-Mart store with her niece and sister. An employee of K-Mart had left an empty pallet lying flat on the floor in the aisle way. As the plaintiff was walking away from an end display, she turned and immediately caught her foot in the slot on the side of the pallet, and fell flat on her face and chest. The plaintiff brought this action against K-Mart based on premises liability and negligence theories of recovery.
