The plaintiff, an 81-year-old retiree, was a patient at the defendant's convalescent center since October 1994. the defendants were familiar with the plaintiff's habits, as well as their method of maintaining the plaintiff's life in their facility. On Aug. 16, 1995, the plaintiff became ill and was rushed to Kennedy Medical Center, where he was diagnosed with pneumonia due to bacteria, influenza, dehydration, hypoxia and decubitus ulcers surrounding his genitals and buttocks area. The plaintiff claimed staff members from Kennedy Medical Center took photographs of his injuries from what they believed was negligent care and treatment. The plaintiff was ultimately transferred to a different convalescent center. The plaintiff brought this action against the convalescent center and its staff members based on professional negligence and elder neglect theories of recovery.
