On Oct. 13, 1994, defendant Dewey Pest Control performed pest control services at the El Gallo Giro restaurant in Huntington Park. On the same day, plaintiff Celso Sanchez, a 47-year-old warehouse supervisor, arrived at work at 6 a.m. The plaintiff claimed he saw residue on the stairs prior to slipping and falling on the stairs at 8:15 a.m. He allegedly walked up the same stairs 10 minutes before he fell. The plaintiff brought this action against the pest control company based on a negligence theory of recovery.
