Facts

On Feb. 4, 1994, the 36-and-38-year-old plaintiffs, a public adjuster and a painter, were siting at the bar consuming their second drink when for reasons unknown, they were forcibly ejected from the defendant bar. Two eyewitnesses testified to anti-semitic insults being shouted by the defendant bouncers at the Iraqi plaintiffs and otherwise supported the plaintiffs' version of the facts. The plaintiffs brought this action against the defendant based on assault, battery, negligent supervision and violation of civil rights theories of recovery.

Settlement Discussions

The plaintiffs made a C.C.P. º998 settlement demand for $75,000. The defendant made a C.C.P. º998 offer of compromise for $10,000.

Injuries

The plaintiffs claimed facial bruises and eye pain. One plaintiff claimed an ulcer from having taken aspirin to relieve his pain.

Other Information

The settlement was reached approximately two years and nine months after the case was filed.
