Facts
On June 5, 1996, the plaintiff, an 84-year-old retired man, was operating an automobile traveling westbound on Pico Boulevard. near its intersection with Cloverdale in Los Angeles. A van in front of the plaintiff's vehicle stopped to make a left turn. The plaintiff stopped his vehicle behind the van and was rearended by the defendant's vehicle. A witness at the scene of the accident indicated that the defendant's vehicle was traveling about 40-to-45 mph at the time of the collision. The plaintiff's vehicle was pushed into and struck the rear of the van. The van was then pushed forward about 20 yards as a result of the force of the impact. The plaintiff brought this action against the defendant based on a negligence theory of recovery.
Settlement Discussions
The plaintiff made a settlement demand for $250,000. The defendant made a settlement offer of $100,000 (policy limits).
