Plaintiff Shannon Earl, sold a piece of land to defendant RDDC Inc., Tony Butler and John and Cheri Butler. The plaintiff agreed to subordinate her purchase money loan to RDDC so that it could get a construction loan. RDDC defaulted on both the construction loan and the purchase money loan. The plaintiff sought to recover the amount she had loaned to defendant RDDC to buy the land. The plaintiff brought this action against the defendant based on a breach of loan agreement theory of recovery.
