Facts
On Dec. 3, 1993, defendant WOW Transportation delivered an intermodal (sea) container to plaintiff Granimar International's yard, at the plaintiff's request. The defendant claimed that upon arrival, the plaintiff took the defendant's delivery paperwork and instructed the defendant where to put the container. After delivery, one of the landing legs sank through the asphalt parking area, causing the container to tip over and damage the marble contained therein.The plaintiff brought this action against the defendant based on a negligence theory of recovery.
