Facts

On Feb. 26, 1995, plaintiff Daniel W. Noble, a 51-year-old refinisher, alleged that his left minor hand was bitten by defendant Tim Torngren's Rottweiler named "Buck." The plaintiff claimed that he had been dirt bike riding and that he walked over to the defendant's truck to speak with the defendant's sister who was seated with Buck nearby. As the plaintiff approached, Buck went up to him and the plaintiff reached out his left hand, at which time Buck bit him. The plaintiff brought this action against the defendant based on a strict liability theory of recovery.
