Facts
On Nov. 26, 1991, the defendant city and county of Denver terminated plaintiff Trina Burks-Richardson's employment. The plaintiff, a deputy sheriff for the Denver Sheriff Department, alleged that she would not have been terminated if proper procedures had been followed. The court held that the plaintiff should have been allowed to cross-examine absent witnesses at her post-termination hearing on May 6, 1992. The defendant contended that having live witnesses rather than affidavits at the post-termination hearing would not have made a substantive difference and that the plaintiff would have been fired anyway. The defendant also contended that the plaintiff sustained no damages. The plaintiff brought this action against the defendant based on violation of due process theory of recovery.
