Plaintiff Harris Corporation, the owner of U.S. Patent No. 4,364,073 which allegedly covered all insulated gate bipolar transistors (IGBTs) that are used in high-voltage, high-current switching applications, asserted a claim for a reasonable royalty on past sales plus prejudgment interest and costs against defendant IXYS Corporation, an alleged infringer. The defendant sold IGBTs to medical device makers. The plaintiff offered to license the patent rights to the defendant, but the defendant refused to take the license. Over 80 percent of the industry was under license. The plaintiff brought this action against the defendant based on a patent infringement theory of recovery.
