Facts
On Sept. 23, 1994, plaintiff Christopher Curran, a 34-year-old automobile salesman, was a passenger in the lead vehicle involved in a rear end accident. He sought care from defendant Don Bolt, D.C., after first seeing his family practice physician. The plaintiff claimed that the defendant caused or exacerbated a protruding disc. The plaintiff brought this action against the defendant based on chiropractic negligence and malpractice theories of recovery.
Settlement Discussions
The plaintiff made a C.C.P. º998 settlement demand for $92,000. The defendant made no settlement offers.
Damages
The plaintiff claimed $587,000 in damages.
Injuries
The plaintiff alleged a protruding C5-6 disc, requiring surgery.
Other Information
The verdict was reached approximately two years and one month after the case was filed. A settlement conference was held on Feb. 2, 1996. It did not resolve the matter. The plaintiff sued the driver of the automobile involved in the accident in a separate action and recovered a settlement, non-apportioned, of $100,000. This fact was not presented to the jury.
