On Aug. 22, 1994, plaintiff Harriet Wieberg, a 56-year-old DMV clerk, was placing items in the passenger seat of her car in the El Camino Real shopping center in Carlsbad when she stepped back into a pothole in the asphalt. The plaintiff claimed her right leg "buckled" and she walked to the mall and asked the security guards to call her husband. The shopping center was owned and managed by defendant Centermark Properties Inc. The plaintiff brought this action against the defendant based on negligence and premises liability theories of recovery.
