Facts
On Sept. 9, 1994, plaintiff Firman's Fund Insurance Company's insured, a Smart and Final store in La Habra, sustained total fire loss. Defendant Breton Construction Inc. was the general contractor on a remodel of the store in 1985. The remodel included electrical work by a subcontractor. The fire started in an area of the store that housed the electrical equipment. The plaintiff brought this action against the defendant based on products liability and negligence theories of recovery. (The products liability claim was dismissed before trial)
