Plaintiff Earl Strei, a 57-year-old sales representative for defendant Clintec Nutrition Company, had been employed by the defendant pharmaceutical firm for seven and one-half years at the time of his termination on Jan. 12, 1994. The plaintiff was initially placed on a performance program (probation) and later terminated. The plaintiff brought this action against the defendant and it's predecessors??? based on wrongful termination, age discrimination, breach of contract and intentional infliction of emotional distress theories of recovery.
