Facts
On May 30, 1993, plaintiff Robert Vorlick, a 49-year-old construction expert witness, was in a parking lot adjacent to defendant K-Mart Corporation's store. A security guard employed by the defendant chased a shoplifter into the adjacent parking lot and allegedly yelled "help me." The plaintiff claimed the shoplifter then ran towards the plaintiff. The plaintiff attempted to restrain the shoplifter, slipped and fell on oil. The plaintiff brought this action against the defendant based on premises liability, negligence and assault and battery theories of recovery.
