On Feb. 1, 1995, plaintiff Gerardo Marucut, a 38-year-old mail carrier, slipped and fell at a duplex owned by defendant Marina Plissak in Millbrae. The plaintiff claimed he slipped on leaves while delivering mail to the duplex. The defendant owned the property but did not live there. The plaintiff brought this action against the defendant based on negligence and premises liability theories of recovery.
