Facts

On Sept. 7, 1995, claimant Farzaneh Sabzevar, a 33-year-old accountant and Yahya Seifizadeh, a 65-year-old retiree, were traveling in a Jetta driven by Sabzevar. The claimants were on their way to claimant Sabzevar's brother's home in West Hills. At the intersection of Neddy and Hamlin, Sabzevar's Volkswagen was allegedly rear-ended by an unidentified "white Bronco or Blazer-type vehicle." The claimant Seifizadeh was a passenger in the vehicle. The claimants brought an uninsured motorist claim. The respondent insurer disputed the nature and extent of the claimants' injuries.

Settlement Discussions

The claimant Seifizadeh made a settlement demand for $85,000 to $100,000. Per the respondent, claimants made a settlement demand for the policy limits of $100,000. Claimant Sabzevar demanded $20,000 to $25,000. The respondent made a settlement offer of $15,000 to Seifizadeh and $6,500 to Sabzevar.

Injuries

The claimant Seifizadeh claimed 3-mm disc bulge at L4-5 with encroachment upon the thecal sac and neural foramina bilateraly requiring surgery. The claimant Sabzevar claimed low back injury, requiring hospitalization and subsequent therapy. The respondents alleged the claimants were not injured as claimed. The respondents further argued that Seifizadeh claimant was not a surgical candidate but suffered from a degenerative condition of the spine. Claimant Sabzevar was seven months pregnant at the time and suffered from a urinary tract infection resulting in a hospital stay. Respondents further argued that both claimants' injuries, if any, were of the uncomplicated soft-tissue type.
