Facts

The decedent, Monica Molinar, was born on June 26,1994 and immediately developed acute respiratory distress requiring intubation and transfer to neonatal ICU at Fountain Valley Hospital. The defendant Douglas Tran, M.D. (ENT) consulted on June 27, 1994 and diagnosed subglottic stenosis. Conservative treatment with steroids and post-hospital follow-up examinations suggested the condition was improving. On Nov. 4, 1994 the infant suffered acute respiratory distress and was diagnosed as suffering from closed tracheal rings and pulmonary sling, requiring emergent and extensive surgery. The infant never recovered from surgery and ultimately died on Nov. 24,1994. The plaintiffs brought this action against the defendant based on medical negligence and wrongful death theories of recovery.

Settlement Discussions

The plaintiffs made a settlement demand for $250,000 lowered to $150,000, during the first day of trial. The defendant made no settlement offers.
