Facts

On July 31, 1993, plaintiff Adrienne Larkin, a 46-year-old attorney, was driving her vehicle at approximately 35 mph when she was cut off by the driver of a van who merged into her lane. The plaintiff slammed on her brakes. The defendant, who was immediately behind the plaintiff's vehicle in the same lane of traffic, rear-ended the plaintiff's vehicle while the van fled the scene. The plaintiff brought this action against the defendant based on a negligence theory of recovery.

The verdict was reached approximately three years and six months after the case was filed. A settlement conference was held on Sept. 22, 1997 before Judge Raymond Arata, Jr. It did not resolve the matter. The plaintiff had sustained three losses of conciousness between ages 7 to 10 and another at age 13. The plaintiff was also involved in an auto accident the year before as well as the year after.
