Facts

Plaintiff Frederick Grunden, a 25-year-old telemarketer, was riding a Yamaha 1000CC motorcycle when it collided with a minivan driven by defendant. The accident occurred at a "T" intersection. Defendant was stopped at the intersection at a stop light, then entered the intersection making a left hand turn. Plaintiff was unable to stop his motorcycle in time and collided with the side of the defendant's minivan causing him to be ejected from the motorcycle. The plaintiff brought this action agaisnt the defendant based on a negligence theory of recovery.
