Facts
On Nov. 17, 1995, the plaintiff, a 45-year-old homicide investigator, was involved in an automobile accident. The plaintiff was on duty, stopped at a traffic light at Topanga Canyon and Victory Boulevard, when his vehicle was rear ended by the defendant's vehicle. The plaintiff contended that the defendant's negligence was solely responsible for the accident and his injuries, including periodic pain in his left shoulder and continual tingling and numbness at his left upper extremity. The plaintiff brought this action against the defendant based on a negligence theory of recovery.
