On Dec. 23, 1995, plaintiff Rosamund Sakol, a 50-year-old salesperson, presented to defendant Dr. Adrien Aiache, for a post-operative examination. The defendant was preparing to remove stitches when an examination light bulb fell and struck the plaintiff on the forehead above her left eye. The plaintiff contended that she suffered serious injuries as a result of incident. The defendant admitted liability, but disputed the nature and extent of the plaintiff's claimed injuries. The plaintiff brought this action against the defendant based on premises liability and negligence theories of recovery.
