Facts
Plaintiff Raymond Safdie, a 49-year-old Doctor of Health Sciences, began treating with Dr. Daniel Stragier, a dentist in 1986. The plaintiff claimed Stragier performed an unnecessary root canal on tooth No. 12 and that the root canal was too short resulting in an abscess. The plaintiff also claimed Straiger placed crown work on teeth Nos. 12, 13, and 15 that was too long and below the standard of care. The plaintiff claimed as a result of Stragier's treatment, he suffered continuous pain in his mouth, jaw and neck area. Additionally, he claimed as injuries problems with his hearing and vision. The defendant contended all treatment performed was within the standard of care, and the plaintiff's problems were not related to any dental treatment he received. The plaintiff brought this action against the defendant based on dental malpractice and negligence theories of recovery.
Settlement Discussions
The plaintiff made a settlement demand for $250,000, reduced to $100,000. The defendant made a C.C.P. º998 offer of compromise for a waiver of costs, increased to $9,999 on the first day of trial.

The verdict was reached approximately one year after the case was filed. SETTLEMENT CONFERENCE: A settlement conference was held on Jan. 8, 1998, before the Hon. Vincent DiFiglia of the San Diego Superior Court, resulting in no settlement. Stragier treated the plaintiff for over 10 years. The plaintiff began having pain in the upper left portion of his mouth in the early 1990s. A cause of this pain was never determined. The defendant referred the plaintiff to several specialists to assist in determining the cause of the plaintiff's problems. None of these specialist could determine the cause. The plaintiff refused to see a general physician or a neurosurgeon as recommended.
