Facts

The plaintiff was 20 years old and mentally retarded. He was hit by defendant cityÆs transit bus in April 1998.
The plaintiff was not employed at the time, but was in a special education program with the settling defendant
unified school district. The bus incident occurred on plaintiffÆs way home from school.
He was dragged by the bus after impact, his lower left leg was injured, requiring amputation.
