Facts
On Jan. 4, 1996, plaintiff, a 33-year-old, was driving on the Hollywood freeway when he was rear-ended by the defendant. A third car hit the defendant, pushing him into the plaintiff again. The second impact was less severe than the first. The plaintiffs, the driver and his 31-year-old passenger, brought this action against the driver in front of him who caused all parties to stop (this defendant was never found for service), the uninsured motorist who rear-ended the plaintiff, and the driver who rear-ended the uninsured motorist, based on a negligence theory of recovery.
Settlement Discussions
The plaintiffs made a settlement demand for $60,000. The defendant made an offer of $5000.
Damages
The plaintiff claimed $6,156 in property damage; $5,064 in past medical bills for plaintiff passenger; $5,835 in medical expenses for plaintiff driver and $2,827 in lost earnings for plaintiff driver.
Injuries
The plaintiffs claimed soft tissue neck and back injuries.
Other Information
The settlement was reached approximately one year and four months after the case was filed. A settlement conference was held on April 13, 1992, before Hon. Carl J. West, resulting in the reported settlement.
