Facts

On Nov. 16, 1994, plaintiff Susan Slivkoff, a 36-year-old homemaker, underwent a laparoscopy, left ovarian cystectomy, and a burch urethral suspension procedure performed by defendant Dr. Nicholas Thanos, employed by defendant Bastanchury Heights Medical Group. On Nov. 29, 1994, Thanos aspirated urine from the plaintiff's abdominal wall seroma. On Jan. 11, 1995, Thanos performed an excision of an abdominal mass and an exploratory laparotomy with enterolysis. On Feb. 1 the plaintiff underwent an excision and drainage of an abdominal wall mass and debridement of subcutaneous tissue and fascia performed by another physician (not a defendant). The plaintiff brought this action against the defendant based on medical malpractice and negligence theories of recovery.
