On Jan. 1, 1995, plaintiff, a 30-year old business woman, slipped and fell on the hallway of defendant's apartment building. The hallway was dark due to broken lights and was wet due to water leaks which existed in the premises. The plaintiff brought this action against the defendant based on premises liability and negligence theories of recovery.

The plaintiff made a C.C.P. º998 settlement demand for $150,000. The defendant made a C.C.P. º998 offer of compromise for $40,000.
