On May 28, 1994, defendant Armen Aghadjanian leased real property on San Fernando Road to plaintiff Anjel Khachikian for a banquet hall and catering facility. The plaintiff brought this action against the defendant based on fraud, breach of lease and negligent misrepresentation theories of recovery. The plaintiff claimed that the defendant represented that the property would seat 144 patrons plus 50 more in the bar. The plaintiff contended that the defendant misrepresented the property, and that the lease was breached. The defendant contended that he made no misrepresentations and did not breach the lease.

The plaintiff made a settlement demand for $20,000. The defendant made no settlement offer.

The plaintiff claimed $85,000 in damages.
