From December 1993 to September 1996, plaintiff Zelma Wadman, a 66-year-old woman, worked for defendant Malaysia Airlines as a ticketing clerk after being hired through an employment agency. She claimed that during her employment, she was subjected to verbal sex and age related harassment by defendant Gilbert Whelan, the former District Sales Manager of Malaysia Airlines, and, as a result, was forced to quit her job. The plaintiff brought this wrongful termination action against the defendants based on constructive discharge, age and sex discrimination theories of recovery.

Per defendant, the plaintiff made a settlement demand in excess of $152,000. The defendants made no settlement offer.
