Facts

Plaintiffs Edward G. Cook, James Bird, Donald Romans, et al., were plaintiffs in a class action lawsuit in California against Christian Harper for conversion, breach of fiduciary duty, fraud, constructive trust and fraudulent conveyance. The plaintiffs obtained a judgment in California Superior Court against defendant Christian Harper in the amount of $12 million. The plaintiffs recorded this judgment in Colorado where the defendant lived. The defendant filed for bankruptcy seeking to have the judgment set aside in bankruptcy. The plaintiffs claimed that the judgment was non-dischargeable because it was based on fraud.
