Plaintiff, Manatt, Phelps & Phillips, a law firm, were retained by defendant Joseph Kornwasse to represent defendants in a construction loan. The plaintiff subsequently performed services in connection with litigation relating to the construction project. The plaintiff law firm brought this breach of contract action, seeking legal fees rendered pursuant to the retainer agreement. The defendant claimed a conflict of interest and legal malpractice as a set-off, that the contract was voidable, and that the fees were excessive.
