Facts
Plaintiff, presently under 2 years of age, was a 4+-month fetus in utero when his mother was involved in a car accident. The plaintiff's mother sustained placental abruption and substantial bleeding during the rest of pregnancy. The child suffers from cerebral palsy, allegedly as a result of the trauma. The plaintiff brought this action against the defendant based on a negligence theory of recovery.
