Facts
On Saturday, April 20, 1996, at 11:15 a.m., decedent, a 70-year-old retiree, was driving her 1988 Pontiac LeMans westbound on Third Street in the No. 1 lane. As she entered the intersection with Orlando Avenue, she brought her vehicle to a stop for oncoming traffic, intending to make a left turn onto Orlando. As she commenced her left turn, her vehicle was struck on the driver's side by a 1990 Seagrave Triple Combo Pumper truck driven by defendant city's fire department engineer. The decedent was hearing impaired and apparently did not hear the fire truck. The plaintiffs, the heirs of decedent, brought this action against the defendant based on a negligence theory of recovery.
Settlement Discussions
Per the defendant, the plaintiff made a settlement demand for $150,000 and the defendant made an offer of compromise for $75,000. Per the plaintiff, the plaintiff made a settlement demand for $250,000, and the defendant made an offer of compromise for $25,000.
