Facts

On March 22, 1997, plaintiff, a 19-year-old missionary, was riding his bicycle on the sidewalk. Defendant, who was driving his vehicle, exited a gas station to go onto the thoroughfare and struck the plaintiff. The plaintiff brought this action against the defendant based on negligence.

Settlement Discussions

The plaintiff made a settlement demand for $75,000. Per plaintiff, the defendant made a C.C.P. º998 offer of compromise for $45,000.
