Facts

On Oct. 23, 1990, plaintiff Glodean Gates, a 55-year-old woman, underwent a hip replacement by defendant Dr. Harlan Amstutz at UCLA Medical Center. Amstutz used a relatively new surface replacement as opposed to the traditional stem type replacement. The device failed in less than four years, requiring a revision surgery to a stem device. The plaintiff brought this action against the defendants based on lack of informed consent theory of recovery.
