Facts

On Dec. 16, 1995, plaintiff Fred Harari, who was 48 years old at the time of the accident was crossing the street which had two lanes in each direction in mid-block at approximately 200 feet from nearest signal to south. Defendant Lynette Grismore, was proceeding southbound in the No. 1 lane at approximately 35-40 mph claimed that she did not see plaintiff. The defendant impacted plaintiff on the right front side of her car. The plaintiff's eye witness (friend) puts plaintiff at approximately dividing line between lanes No. 1 and 2. The plaintiff brought this action against the defendant based on negligence.
