Facts

On Nov. 13, 1997, plaintiff, a 22-year-old horse trainer, was a passenger in a vehicle driven by the defendant. The plaintiff was thrown from defendant's vehicle during a high speed accident. The driver was intoxicated and cited for driving under the influence and reckless driving. The plaintiff was treated at UC Davis Medical Center on an emergency basis. He sustained upper and lower back soft tissue damage and extensive bruising from the accident. The plaintiff brought this action against the defendant based on a negligence theory of recovery.

Settlement Discussions

The plaintiff made a settlement demand for $75,000. The defendant made an offer of compromise for $55,000.
