On June 1, 1995, plaintiff Martin, an actress, model and author, claimed that Dr. Levi, D.D.S., performed periodontal surgery without her consent. There were two consent forms in plaintiff's file, neither of which were signed. The surgery was gingivectomy to remove amalgam tattoo believed to be caused by the leaking crown. The plaintiff suffered "hole" in gums between teeth No. 11 and 12. The plaintiff brought this action against the defendant based on dental malpractice and lack of informed consent.
