The plaintiff, Dr. Edward Erath, was an advisor in Los Angeles city and county government in the 1960s and 1970s, through his non-profit company, Center For Technical Services, a "think tank." During the 1970s, the plaintiff developed methods applying modern technology and management techniques, learned in the defense and aerospace industry, to government operations. The plaintiff developed 11 years of records and data that were reduced to reports, studies and other documents. In late 1983, Dr. Erath loaned these records to the UCLA Graduate School of Management. In 1994, the plaintiff requested that these records, data and publications be returned to him. Defendant UCLA, however, lost the documents.
Settlement Discussions
The plaintiff made a C.C.P. º998 settlement demand for $150,000. The defendant made a C.C.P. º998 offer of compromise for $50,000.
