On July 17, 1996, plaintiff Murray Rund was driving his vehicle with his wife Mary Jo Rund as his passenger. Murray was stopped at a red left turn light at the intersection of Fanita and Mission Gorge Road in Santee. Defendant Diane Hart rear ended the plaintiffs while stopped at the light.
