In January 1995, plaintiff Jacqueline Brown was referred to defendant Dr. Ian Renner, relative to complaints of back and abdominal pain. From May 30, 1995, through Sept. 27, 1996, Dr. Renner performed four separate procedures known as endoscopic retrograde cholangiopancreatography (ERCP). The ERCP procedure involves passage of an endoscope through the mouth, esophagus and stocmach into the duodenum. After the common opening to ducts from the liver and pancreas was visually indentified, a catheter is passed through the endoscope into the ducts. Contrast material is then injected into the ducts and X-rays are taken. Additionally, following the initial on May 30, 1995, ERCP, therapies including sphincterotomy, balloon dilation and stent placement were performed. Jacqueline Brown experienced severe pain following each of the procedures and, after Dr. Renner's last ERCP of Sept. 27, 1995, was unable to eat regular food. As a result, she was hospitalized in December 1995 for placement of a Groshong catheter or feeding tube. Brown was thereafter treated for acute pancreatitis believed to have been caused by manipulations that were part of the ERCP procedures performed by Dr. Renner. Brown's treatment at UCLA continued up to the date of trial. Jacqueline Brown was employed as a loan processor until Oct. 17, 1995 when the pain associated with Dr. Renner's procedures prevented her from working. Brown had not returned to work as of the date of trial. Jacqueline Brown's husband, Michael Brown asserted a claim for loss of consortium.

Settlement Discussions

The plaintiffs made a C.C.P. º998 settlement demand of $150,000. The defendant made an offer of $10,000.
