Facts

On Nov. 16, 1997, plaintiff Celso Villa was traveling northbound on Main Street in the No. 1 lane at 35 mph when he entered the intersection of Main and Santa Clara to get on the 5 north freeway on-ramp. Celso Villa had passengers, Beda Villa and Celso Lopez (also plaintiffs) in the vehicle with him. Meanwhile, defendant Chung Kao Kim made a left turn from southbound Main to the 5 north freeway on-ramp and the collision occurred in the intersection.

Settlement Discussions

The plaintiffs demanded $10,000 each at trial, while the defendant made no offers. According to the defendant, plaintiffs failed to respond to C.C.P. Section ______________ (can't read report) and 2034 demands and were precluded from offering expert testimony and medical bills.
