Facts

The plaintiff claimed that she was struck by defendant on Nov. 13, 1997. The plaintiff further claimed that the accident exacerbated a neck condition from neck surgery four months before the accident, as well as causing new low back injury, and a driving phobia.
The defendant admitted liability but contended that the impact was minimal and that the injury to plaintiff could not have resulted from the collision with defendant.
