Facts

On Dec. 5, 1997, at approximately 4:00 a.m., the decedent, 81, slipped and fell at defendant hotel. The decedent slipped, fell and struck her head as a result of an allegedly unsafe bath mat and polished marble tiles in the bathroom of the hotel. Apparently, decedent sustained a minor laceration to the head with no apparent neurological complications.
Upon returning home to New York, decedent began to experience concentration and memory problems. She was diagnosed at the hospital with a subdural hematoma that required surgery. On Jan. 8, 1998 while in surgery for drainage of the hematoma, decedent lapsed into a coma and died on April 4, 1998. Decedent left as heirs her 80-year-old husband and two adult children.

Settlement Discussions

The plaintiff demanded $450,000, which was reduced to $350,000. The defendant initially offered $60,000 which was raised to $100,000. The case was settled shortly before trial for $200,000.
