Facts
On January 3, 1995, at approximately 11:00 p.m., an elderly passenger attempted to board the Blue Bus (number 1) at the intersection of Federal Avenue and Santa Monica Boulevard while it was raining. The passenger asked the bus driver if he could pay the senior citizenÆs fare due to his age, but he neglected to bring identification. The bus driver denied the request and passenger was 15 cents short on his regular priced fare.
The passenger, who was a slight, white haired gentleman with a British accent, became annoyed in light of the fact that he had never been asked for identification before. Bus driver and passenger exchanged words. Then the bus driver got out of his seat and punched the passenger in his chest, causing him to fly backwards out of the bus, missing the steps altogether.
Passenger landed violently on his right hand causing severe injury. Liability is clear, a bus supervisor apologized for the incident and admitted that the driverÆs actions were unacceptable. The Blue Bus paid for the subsequent surgery and hospitalization.
