Facts
William Brady, ex-husband of defendant Colleen Drews, owned Bonnet To Boot, a business repairing and
restoring British automobiles. The plaintiff took his 1956 Rolls Royce Silver Cloud I to Brady. Brady left the
vehicle on the residential property he shared with defendant Colleen Drews when he was ordered off the
property due to divorce proceedings in June 1992. The vehicle was removed from the property by Colleen
Drews in November 1992, left at a repair facility until April 1993, and was taken to Oregon. The plaintiff
reported the vehicle stolen in December 1992. It was recovered in Oregon in 1994.
Settlement Discussions
The plaintiff demanded $100,000 before trial, reduced to $65,000 during trial. The defendants offered $27,500 on the day of trial.
Damages
$50,000 - $60,000 out of pocket loss; $500 per day for eight years as fair market rental value for loss of enjoyment of vehicle; $40,000 - $50,000 for repair of the vehicle.
Injuries
Out of pocket loss for cost of restoration; loss of enjoyment of vehicle for eight years; cost to repair; intentional interference with economic advantage; and oppressive, fraudulent and malicious acts.

Defendant Colleen Drews has asked the court to find that she is the prevailing party and for a judgment in her favor based on her C.C.P. Section 998 offer of $10,000 in 1998.
