Facts

Plaintiff was employed for 11 years by defendant in its security department. In November 1998, plaintiff was
terminated.
The plaintiff alleged that he was laid off because of his Hispanic origin, his age and the fact that he gave
testimony against the company in another lawsuit.
The plaintiff further alleged claims for breach of contract, breach of the covenant of good faith and fair dealing
and intentional and negligent infliction of emotional distress.
The defendant contended that plaintiff was laid off as a result of a reduction in the
workforce and that his protected status and prior testimony played no role whatsoever in the
decision to lay him off.

Result

The court granted defendantÆs motion of summary judgment with respect to plaintiffÆs complaint and each cause of action contained therein on the grounds that there was no triable issue of material fact.
